OFFICIAL RULES

The following promotion is intended for viewing in the United States only (including its territories, possessions, and commonwealths, except Puerto Rico) and will be construed and evaluated according to United States laws. Do not proceed in this site if you are not a legal U.S. resident, 21 years or older, and accessing this site in the United States, its territories, possessions, or commonwealths (except Puerto Rico).

Prize: One (1) Winner will have their design featured on http://www.hebelaac.com/ and in a major publication. All decisions related to the Hebel AAC Green Home Contest shall be at Xella Aircrete North America, Inc.'s sole discretion. Actual value of prize depends on market fluctuations.

General Prize Conditions: Some restrictions may apply. Prizes cannot be transferred, substituted or redeemed for cash except at Xella Aircrete North America, Inc.'s sole discretion. Xella Aircrete North America, Inc. reserves the right to substitute any prize, or portions thereof, with a prize of comparable or greater value, at its sole discretion.

Winners' Announced: Beginning on or about June 15, 2010 you may obtain the name of the Prize Winner, by going to the Hebel Website (http://www.hebelaac.com/).

REGISTRATION

No purchase necessary. Entry requires completion of an email registration or postal mail of entry form.  All information must be complete to be considered a valid entry.

How to Enter: Beginning at 9:00 a.m. Eastern Time ("ET") on October 12, 2009 until 5:00 p.m. ET on May 15, 2010 (the "Contest Period"), you may enter the Hebel AAC Green Home Design Contest  by either emailing submission requirements to: hebel-usa@xella.com or by mail to Hebel AAC Green Home Contest, 2400 Hebel Boulevard, Adel, GA 30162.

All eligible entries received will be entered in the contest. Xella Aircrete North America, Inc. ("Contest Sponsor"), is not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Contest; inability to access the Hebel AAC Website; theft, tampering, destruction, or unauthorized access to, or alteration of entries; entries that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any website; printing, typographical, or human or other errors; and any entries which are late, lost in the mail, incomplete, delayed, misdirected, stolen, mutilated, inaccurate, illegible, or any combination thereof. Proof of online submission is not considered proof of delivery or receipt. All entries become the property of Contest Sponsor and will not be returned. A purchase will not increase chance of winning. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE COTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, CONTEST SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

All submissions become the sole property of Contest Sponsor and may be used in any manner, print, online, commercial or otherwise, in any and all media now known or hereafter devised throughout the universe in perpetuity.

If you are mailing your submission, it is recommended to save the files to a CD or DVD in pdf format. If you are emailing your submissions, email sizes should not exceed 10MB.

Eligibility: This Contest is open only to legal residents of the U.S. and its territories, possessions and commonwealths (excluding Puerto Rico) who are 21 years of age or older as of October 12, 2009, except employees and members of their households, whether or not related, and immediate families (spouses, parents, siblings, children and each of their respective spouses regardless of where they reside) of Contest Sponsor and their respective parent companies, subsidiaries, and affiliates, and their advertising and promotion agencies and all local sponsors are not eligible to enter or win the Prize. Contest Sponsor reserves the right to conduct a background check on any potential Prize Winner and reserves the right in its sole discretion to disqualify any person based on such background check if Contest Sponsor determines in its sole discretion that awarding the prize to such potential Prize Winner might reflect negatively on Contest Sponsor. By entering, all participants and/or entrants agree to release the Released Parties from and against all claims and damages arising in connection with each entrant's participation and/or entry in the Contest and/or his/her receipt or use of any element of the Prize awarded in this Contest. Any and all warranties and guarantees with respect to any prize element are subject to the manufacturer's terms. This contest is governed by U.S. law and is subject to all applicable federal, state and local laws and regulations. Void in Puerto Rico, outside the U.S. and its territories, possessions, and commonwealths and where prohibited by law.

How the Winner will be Determined:

JUDGING

Judging of Winner and Notification: One (1) potential Prize Winner will be chosen by Sponsor by a panel of judges and monitored by Xella Aircrete North America, Inc. ("Contest sponsor"). The potential Prize Winner will be contacted either by phone, e-mail, in writing, or in person via televised ambush at the Prize Winner's home on or about June 1-10, 2010 (subject to change). The potential Prize Winner may be filmed during such visit by Sponsor. The Prize Winner will be required to execute an affidavit of eligibility and release of liability and publicity (where permitted by law), and return same, fully-executed, within three (3) business days of date of issuance of prize notification. If Contest Sponsor is unable to contact the potential Prize Winner within five (5) business days of the initial attempt, if the potential Prize Winner fails to return all requested forms fully-executed by the specified date, or if the potential Prize Winner fails to comply with these Official Rules, including traveling on the dates and times required by Contest Sponsor, his/her place as a possible Prize Winner will be forfeited at Contest Sponsor's discretion, and an alternate Prize Winner shall be selected. For the avoidance of doubt, if Contest Sponsor elects to award the Prize during a televised event as described above, the potential Prize Winner must travel to the location designed by Contest Sponsor and on the dates required by Contest Sponsor (at Contest Sponsor's expense) to be eligible to win the Prize.

Contest Sponsor and Contest sponsor's decisions with respect to the Prize Winner and other matters pertaining to the Contest shall be final and binding. By entering into the Contest, each entrant consents to the use by Contest Entities and their designees of his/her name, photograph, likeness, biography, voice, performance and/or video (including any footage compiled when the potential Prize Winner is contacted) for advertising and promotional purposes including "ambush style" or studio-based on-air camera appearances to announce the Prize Winner in any and all media, including online announcements now or hereafter known, worldwide and without limitation and without additional compensation, notification or permission, except where prohibited by law. In addition, participants in any on-air presentations will be required to sign any agreements and releases designed by Contest Sponsor with respect to their services and performances. Contest Sponsor and its designees may exploit, edit, modify, and distribute any footage compiled during the period when the potential Prize Winner is contacted, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or not currently known, throughout the world in perpetuity without additional compensation, permission or notification to any potential Prize Winner or any third party. The odds of winning the Prize depends upon on the number of eligible entries received for the entire Contest Period.

General Conditions: Contest sponsor's decisions with respect to the Prize Winner and any other matters pertaining to the Contest shall be final. All material submitted with contestant entry form will become the property of Contest Sponsor. All material submitted must be the property of the contestant and not a derivative of any copyrighted materials. If Contest Sponsor is unable to contact the potential Prize Winner within three (3) business days of the initial attempt to contact, if a potential Prize Winner fails to complete and return all requested forms by the specified date or if a potential Prize Winner fails to comply with any of the requirements, his/her prize will be forfeited and an alternate prize winner shall be selected. By entering into the Contest, all entrants consent to the use of their name, photograph (including photographs submitted by them to Contest Sponsor), likeness, biography, voice and/or video for advertising and promotional purposes, including online announcements, worldwide and without limitation and without additional compensation, except where prohibited by law. The odds of winning depend upon the number of eligible entries received for the applicable drawing.

By participating in this Contest, each entrant agree to be bound by these Official Rules and the decisions or interpretation of Sponsor regarding the Official Rules, which are final and legally binding in all respects. In the event that a prize cannot be awarded for any reason or a winner is not capable of redeeming a prize for any reason, Sponsor shall not be obligated to award any prize, and Sponsor reserves the right, in its sole discretion, whether or not to substitute prize (or portion of prize) with a prize of comparable or greater value or cash value. If, for any reason, more than the stated number of prizes are available and/or claimed, Sponsor reserves the right to award the prizes in such category by random drawing from among eligible prize claimants in such prize category or in a manner to be determined by Sponsor in its sole discretion. Non-compliance with these Official Rules may result in disqualification. An individual is not a winner until he/she and his/her parent or legal guardian have fully complied with these Official Rules. No transfer, assignment, cash redemption, or substitution of a prize is permitted. Prizes are not exchangeable for cash, merchandise, or services.

Entry materials that have been tampered with or altered are void. If, in the Sponsor's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Contest, the Contest Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and void any entries submitted fraudulently, to modify or suspend the Contest, or to terminate the Contest and conduct a random drawing to award the prize using all eligible, non-suspect entries received as of the termination date. Should the Contest be terminated prior to the stated expiration date, notice will be posted on the Hebel AAC Website. Any attempt by an entrant or any other individual to deliberately damage any website or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Contest Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. In the event of a dispute as to the identity of the potential Prize Winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Such Authorized account holder will be required to comply with these Official Rules.

Privacy: Sponsor will collect personal data from entrants when they enter this Contest, and this information will be used for the purposes of administering the Contest, publicizing the Contest, and other promotional purposes that benefit the Sponsor.

Publicity: Unless prohibited by law, participation in the Contest constitutes each entrant consent for Sponsor to use each entrant’s name and age, hometown, and state of residence for Contest or promotional purposes in any media now known or later developed, without payment or consideration to the entrant. Each entrant as a condition of participation in the Contest, grants Sponsor permission to reproduce, publish, distribute, and otherwise use all rights in his/her photograph, of will be required to execute a publicity release granting Sponsor such rights, unless prohibited by law.

Venue and Applicable Law: This Contest will be administered in the State of Georgia, and by participating, all entrants agree that: (a) the laws of the State of Georgia will apply exclusively to this Contest, and (b) any dispute with respect to this Contest will be resolved exclusively in either the federal or state courts located in the State of Georgia.
